Transitional rental contracts
Unlike many countries, rental contracts in Italy exceeding 30 consecutive days follow a standardized legal format. For international students, the most common option is the Contratto di Locazione Transitorio, designed for demonstrably transitional stays of between 1 to 18 months. Rental agreements shorter than 30 days are more flexible, with terms freely negotiable between landlord and tenant.
Tenant and landlord responsibilities are governed by Articles 1571 et seq. of the Civil Code, which outline statutory lease terms, rights, obligations, and termination conditions. Law No. 431 of 9 December 1998 (Article 2) specifically regulates the Contratto Transitorio. For stays exceeding 18 months, the 4+4 contract format applies, stipulating for a minimum 4-year tenancy with a 6-month notice period for early termination which can be triggered from the second rental year.

REGISTRATION OF TRANSITIONAL TENANCY
(Law 9 December 1998, n. 431, article 5, paragraph 1)
TERMS AND CONDITIONS
1 - The tenants declare not to take up permanent residence in the above housing unit.
2 - The landlord has the obligation to confirm the legal right of stay of the listed tenants and the nature of the stay for the stipulation of this contract type (proof of study attached)
3 - The contract has a duration of X months, from XX/XX/XX to XX/XX/XX
There is no need to cancel the contract at the deadline indicated above as there is no automatic renewal.
4 - The rental fee of the total duration is agreed at Euro XXXX.XX, an amount that the tenants undertake to pay monthly by advance bank transfer, in X equal advance installments of Euro X,XXX.XX, by the first day (1) of each month.
5 - Failure to pay all or part of even one installment of the rental fee by the deadline indicated above will result in termination of the contract pursuant to art. 1457 of the Italian Civil Code.
6 – The monthly fee for fixed ancillary charges of Euro XXX.XX includes: ordinary condominium expenses (cleaning of common areas, concierge, heating, water) and internet.
Electricity utilities are provided inclusively with a monthly limit of Euro XXX.XX.
7 - The tenant undertakes to keep and return the leased property in the conditions in which it was delivered and undertakes to carry out normal cleanings before returning it.
8 - The tenant cannot transfer the contract to others or sublet the property.
9 – At the time of this contract, the tenant has undertaken to pay the amount of Euro X,XXX.XX as a security deposit to guarantee the regular payment of the rents and compliance with the terms of this contract.
This deposit will be returned in full after verification that the tenant has fulfilled all rental obligations and that the property is returned in the condition in which it was delivered at the time of the contract.
10 - The landlord declares that he wishes to avail himself of the method of taxation on income from the rental of buildings provided for by Legislative Decree no. 23 of 14/03/2011 called “cedolare secca” (dry coupon).
11 - The tenant declares that he has received any information and/or documentation regarding the building, its appliances and utilities.
12 - For anything not provided for, please refer to articles 1571 et seq. of the civil code and articles 2 and 5 of law no. 431 of 9 December 1998.
Pursuant to art. 1341 of the civil code the parties, after reading and rereading each clause, declare that they accept and expressly approve them.
